Microsoft Subpoenas Canopy and Law Firm Hunting for Documents from Caldera v. MS to use in Novell v. MS (antitrust)

The Novell/Canopy/Caldera/DR DOS story continues, and Novell and Microsoft are in the middle of it all, battling in discovery in the Novell v. Microsoft antitrust litigation -- that is the litigation over WordPerfect currently before the US District Court in Maryland in pretrial discovery. Microsoft politely asked for [PDF] all documents "relating to Novell's sale of PC operating systems claims to Caldera and Novell's involvement with Caldera's case against Microsoft", as well as "all documents produced by parties and third parties" in the Novell v. Canopy case. Why?

SCO has filed its First (Non-Substantive) Omnibus Objection to Claims [PDF], which I gather is where a company tries to shuck off any claims they think they can. And the omnibus hearing scheduled for October 15, 2008 has been cancelled. Also Tanner has filed its 12th bill in the bankruptcy. Here's the relief SCO asks for in its Omnibus Objection to Claims: 7.

I've been thinking about something for a few days now. It's about the latest Novell-Microsoft deal that was announced on August 20, where Microsoft agreed to buy another $100 million worth of vouchers from Novell. I was wondering: how come two public companies can make a deal that seems to me to be material and yet keep pieces of the deal secret? We never did get all the details about the original deal from November of 2006. And now there's this new one, which so far is only described in broad strokes. I wonder if we will be kept in the dark about some of its terms too?

I found a treasure on YouTube. Harvard's Berkman Center for Internet & Society has a channel on YouTube now. And they held a conference in September on the US antitrust trial against Microsoft, collecting many of the players in that famous litigation, including David Boies. So it's your opportunity to see him in action. As usual, he's impressive. I think you'll find his explanation of trials as morality plays intriguing. He talks about highly technical trials, and how the judge finally has to decide who he believes, based on credibility.

A bit over a year ago, I blogged about Microsoft patenting sudo. They're at it again. Guess what they patented this time. According to ZDNet, Microsoft patented the Page Up and Page Down keys. Yeah, no kidding. I really like how they linked to a keyboard from 1981 where you can see the aforementioned keys on the numpad.

I was originally going to post with a rant asking Why why WHY is it that textbook authors seem to have the writing skills of a bad high school student. In my COMP601 textbook is the phrase: "In today's computer systems, software is an increasingly critical component." ARRRGH.And I don't think I've chosen a bad Master's program - when looking at other schools, they all seemed to have textbooks with similarly poor writing.
