Novell has filed its Response to SCO's Notice of Voluntary Dismissal. It's ascerbic and funny as can be. It shows the court each and every tricky bit it thinks SCO might just be angling for. I saw in the email exchange between the SCO and Novell attorneys that were attached to the David Melaugh Declaration that SCO has stepped on Novell's last nerve with its trickiness. And here we see the result. Novell points out each and every conceivable thing SCO might be trying for, leaving nothing for SCO to try later.

SCO Makes Its Move in Utah: Asks to Waive Claims, Get Final Judgment 16 weeks 2 days ago
SCO has filed a notice asking the Utah District Court to dismiss its stayed claims and issue a final judgment with respect to both the August 10, 2007 and the July 16th, 2008 orders, so SCO can appeal right now. It points out that Novell was told to file a final judgment, and it hasn't done so. This is what Novell told the court SCO was going to do next, and it indicated that it would be responding with its own "Oh, no you don't" memorandum in opposition pronto.
Novell and SCO Agree on Interest, Trust Amounts; Final Judgment Still in Dispute 18 weeks 4 days ago
Novell filed today, as per the deadline, two documents, one an unopposed filing regarding interest due Novell by SCO -- SCO has agreed to the sum of $918,122 in prejudgment interest and $489 per day until the final judgment is entered. That could be a while. The second filing informs the court that Novell still believes that a final judgment is premature, since the arbitration is not yet finished.
